Definitions and scope of services:

• Everybody may take cognizance for free with the content of the Regulations. Everybody may print, save, and digitally reproduce the content of the regulations with the use of any electronic media.
• Regulations are accessible in the form that enables their saving and display in the ordinary procedure (in the HTML or/and PDF document format).
• These Regulations are Regulations, as described in the paragraph 8 of the Act of 18 July 2002 on electronic service (Journal of the Laws number 144, item 1204).
• These Regulations stipulate the rules according to which individual users (hereinafter called “Users”) can use the interactive service (hereinafter called “Service”) provided by Can't Stop Games Sp. z o.o. directly, or by means of web sites of different service providers (hereinafter called "Web Sites").
• The Service Provider is Can't Stop Games Sp. z o.o., with the head office in Wrocław, at 264 Borowska St., registered in the National Court Register – register of entrepreneurs maintained by the District Court for Wrocław-Fabryczna, VI Economic Unit of the National Court Register, entry number KRS 0000299894 (hereinafter "Service Provider"). Co-provider is Ganymede Sp. z o.o., with the head office in Kraków, Al. 29 Listopada 45a, registered in the National Court Register – register of entrepreneurs maintained by the District Court for Kraków-Śródmieście, XI Economic Unit of the National Court Register, entry number KRS 0000204304.
• The User is any person having access to the game Tanadu, especially people having their own profiles in the game.
• The Service Provider informs that no individual contracts with the Users are entered. All Users use the Services offered by the Service Provider in the Service according to the rules stipulated only in these Regulations.
• Within its technical and operational possibilities, the company Can't Stop Games Sp. z o.o. will make the game Tanadu as well as all other Services available to Users, trying to grant possibly continuous and problem-free access to them. Can't Stop Games Sp. z o.o. is not liable for any breaks in providing the Services, especially those due to technical reasons or maintenance.
• The game Tanadu offered by the company Can't Stop Games Sp. z o.o., as well as other Services, are assigned solely for entertainment. It is forbidden to use them for the purposes connected with the gainful or economic activity. Especially it is forbidden: sale of the registered profiles of the player, sale of the objects and resources from the game, providing services in the game to other players if those activities are connected with receiving payment outside the game.
• In case of some Services the User has the possibility of using the offer of the partners of the company Can't Stop Games Sp. z o.o., with whom it has entered into contracts (hereinafter "Web Sites" or "Partner Web Sites"). In such a case a separate contract is made between the User and the partner of Can't Stop Games Sp. z o.o.
• The Service Provider is not liable for the inaccessibility of the game or loss of data for reasons beyond its control. Users will be informed in a timely manner of the planned or anticipated changes or interruption in the providing of the Services.

Technical conditions:

• These Regulations set the conditions of the use of the game Tanadu, created by Can't Stop Games Sp. z o.o. The use is possible first of all from a personal computer connected to the Internet via dial-up modem, ISDN modem, DSL modem or other equivalent connection. Moreover, it is possible to use a variety of other terminal devices, able to work on the Internet; however the range of functions and/or visualisation may be limited in this case.
• The object of these Regulations are not possible issues related to the provision of connections as well as with linking web sites and online games to the third parties software (web browser, access software), because services of that kind are not offered by Can't Stop Games Sp. z o.o.
• Users themselves are responsible for the update and usefulness of their hardware and software used.

Contract:

Access to the Services offered by Can't Stop Games Sp. z o.o.:

• Access to the game Tanadu is possible only for persons having their own individual profile in the game.
• Access to the Services offered by Can't Stop Games Sp. z o.o. can take place via the Partner Web Sites. Registration to the Partner Web Sites is controlled by their own regulations.
• The Service Provider is entitled to introducing new Services, changing, deleting, temporary exemption or limiting functionality of individual Services (e.g. disabling access to the Service, excluding, change or limiting the functionality of individual Services), without prior notification of the Users.

Deleting a profile in the game:

• In the event of a legitimate reason (e.g. prolonged inactivity), Can't Stop Games Sp. z o.o. has the right to delete the User’s profile.
• The User has the right to delete his/her own profile in the game at any time, subject to the proper procedure. For security reasons, profile is not removed immediately, and the User has the right to revoke his/her decision before the expiry of the specified period of time, informing the Service Provider about it through the tools available in the game.

Unlawful actions and their consequences:

• In connection with providing the Services by the Service Provider, the User must not provide illegal contents. The User may not introduce or store and in particular present within the scope of the game and Services provided by Can't Stop Games Sp. z o.o. any opinion or activities:
  • violating the law, particularly violating legal regulations or rules of social coexistence, good manners, widely recognized customs or rules of conduct, including pornography, racist materials, or including content generally regarded as vulgar or offensive;
  • supporting or declaring radical social attitudes, especially all kinds of discrimination based on sex, age, disability, race, religion, nationality, political or social opinion, trade union membership, ethnic origin, denomination, sexual orientation;
  • promoting attitudes and political views, especially openly promoting politically active organisations or individuals;
  • violating or likely to violate the rights of others, particularly property or personal copyrights, business secrets, industrial property rights, rights of publicity or other personal rights of others, including those of the Service Provider or those of other Users;
  • violating or likely to violate the rights to trademarks, geographical indications, indications of the company, the rights to the company or any other protected designations of origin of goods or services;
  • calling for a prohibited act (offence, misdemeanour) or violating the rights of others, or that can assist in the committing of an offence (misdemeanour) or violating the rights of others, and particularly materials which provide instruction for hacking, cracking, phreacking, terrorist activity;
  • constituting computer software designed to circumvent technological protection of works or objects of related rights, or computer software designed or adjusted as to enable to use protected services within the meaning of the Act of 5 July 2002 on the protection of certain electronically supplied services based on, or consisting of, conditional access;
  • constituting computer software that can be used for the computer intrusion, illegal obtaining of information transmitted in computer networks, systems disruption or preventing the processing, storing or transmitting data in computer systems, unauthorized destruction of data, (including all types of viruses, “Trojans”);
  • containing commercial information, advertisements, or any announcements of a commercial nature.
• The company Can't Stop Games Sp. z o.o. is not liable for losses resulting from the breach of duties which are the responsibility of the User.
• The User undertakes not to use any possible cheats, hacks, modes, bots, or other unauthorized by Can't Stop Games Sp. z o.o. tools, programmes, means and methods, whose aim is to change the experience of the game Tanadu or gaining an advantage over other players.
• No User has the right to use any means, mechanisms or programs that may cause problems and disruptions in the functioning of the web sites and change the course of the game. Users are not permitted to take any action which might cause an excessive burden on the technical capacity of the Service servers.
• Notwithstanding any other matters regulated by law or contract, the company Can't Stop Games Sp. z o.o. has the right, in its sole discretion, to take the following measures, if the User culpably violates the statutory laws, rights of third parties, these Regulations or any other appropriate complementary arrangements or rules of the game:
  • change or delete the content;
  • warn the User;
  • publish information about misconduct in the game disclosing the name of the User;
  • temporarily or permanently block the User’s access to the game and content contained on the Can't Stop Games Sp. z o.o. website;
  • exclude the User.

Data protection:

• By creating a profile in the game Tanadu, the User consents to the disposal by the Operator of the data related to him/her under the terms of these Regulations.
• Processing of information related to Users, including those having the nature of personal information about the players, takes place in accordance with the Personal Data Protection Act and the Act on Electronic Services.
• For the purpose of providing the Services, Service Provider processes Users’ data, such as login and password, e-mail address, as well as User’s IP number and a unique identification number generated on the basis of the configuration of hardware and software of the computer.
• Payments for the Tanadu game are managed by Ganymede sp. z o.o., which is allowed to keep and process Users' data needed to provide said Service.
• User may entrust the Service Provider with his/her other personal data, by posting them on his/her profile. These data will be processed by the Operator to present them within the scope of the Service provided.
• User may at any time complete, change or delete data included in the game Tanadu and other Services provided by the Service Provider, as well as demand completion, change or removal of his/her other personal data processed in providing the Services, with the reservation of the data, which Service Provider will remain entitled to process under the appropriate legislation. The User’s demand to remove data referred to in section 3 is equivalent to a demand to remove the profile of the player.
• Service Provider uses cookie files to collect information related to the use of the Service by the User. Cookie files enable:
  • to identify the User’s computer, for the purpose of ascertaining that the profile in the game is used by the person who inputs the correct login and password;
  • to collect non-personalized traffic data in the Services.
• Participation in the game Tanadu (obtaining the User status) signifies consent for the presentation in the game of the login chosen by the User, results of his/her contests and records obtained by him/her. Other data of the User, having the nature of personal data will not be disclosed to any third party, without the User’s express consent communicated through the tools available in the game, subject to the following section.
• The Service Provider reserves the right to disclose selected information about the User to the bodies or third parties that report to request the disclosure of such information on the basis of the appropriate law.
• The Service Provider reserves the right to process the data of an anonymous nature, which do not enable unambiguous identification of persons, particularly data on sex, age, origin, and other similar information as well as data on weekly, monthly and annual use of the game, as well as statistics on a player (ranking position, number of battles won, etc.). These data will not be combined with data of a personal nature relating to the Users, nor will they be collated with the data that could enable their identification. Information of this type will be used by the Service Provider solely in order to improve the quality of the services provided.
• The Users’ data will be stored for no longer than necessary, given the scope of the consent given by the User under these Regulations, and will be removed from the system.
• The contact with the User that takes place via e-mail is also possible due to cooperation with partners who redistribute the game on their sites. Data given at registration on a particular Site are not the property of Can't Stop Games Sp. z o.o. and are not accessible to the company.
• Can't Stop Games Sp. z o.o. Customer service never asks Users for the individual password to any of the Services. Users commit themselves not to pass their passwords to third parties. Hereby, special concern about the safety of the password and other access information is recommended to the Users. Can't Stop Games Sp. z o.o. shall not be liable for any loss of data or other damage resulting from activities of third parties that have gained access to the User’s profile owning to the password or other information disclosed by him/her.

Versions of the game:

• Basic version:
  • Can't Stop Games Sp. z o.o. makes the game available to Users from the moment of creating a profile. In this case the User has at his/her disposal only a basic version. The Use of the basic version of the game is free of charge. The basic version (without limiting the right of the Can't Stop Games Sp. z o.o. to terminate the operation of the game) is not limited in time and can be used in full. It should be noted that in the basic version not all possible options are available to the User.
• Premium features:
  • It is possible for the User to obtain for a fee an access to features which are not available in the basic version (hereinafter called Premium features). The information about what kinds of Premium features are offered, at what price, how they work and what conditions must be met to make them work are contained in a dedicated part of the game. Thus, depending on the specific Premium features and Premium rates, it may be a single payment, top-up, (purchase of the special currency in the game: Gleemmers), or payments for a specified time interval (for example: day, week, month, quarter, term, year).
  • Can't Stop Games Sp. z o.o. reserves the right to offer at any time new Premium features. In view of the continuous refinement of the game, Can't Stop Games Sp. z o.o. also reserves the right to discontinue offering any Premium features and/or to offer them also in the free basic version. If the User has already made payments for the Premium features for the time period set in future and can no longer use them because they are no longer in the offer and/or they are also available in the basic version, Can't Stop Games Sp. z o.o. will offer the User in return other Premium features. In this case the User can terminate the contract with an immediate effect. Other claims of the User are excluded.
  • Ordering a Premium feature by a User who is a minor is equivalent to explicit assurance that he is in possession of means necessary for the payment or that they were given to him for this purpose.

Users’ Accounts

• A person may have only one profile in the game, which must be created by himself/herself and then be used exclusively by himself/herself. The Service Provider reserves the right to control the compliance with this provision by using available technical and operational measures.
• In the case of violation by the User of provisions of the section above, the Service Provider shall be entitled to closure of all the subsequent profiles of the User, together with all his/her contents, including the special currency (Gleemmers) purchased by the player.
• Continuing violations referred to in section no. 1 may cause the Service Provider to take a decision to eliminate all profiles of the person and his/her exclusion from the game. Service Provider reserves the right to close any profiles reasonably suspected of being used by the same person or controlled by him/her.
• Service Provider is not responsible for events involving gaining access to the profile in the game by unauthorized persons, as well as for the results of those persons’ activities.
• Creating a profile in the game is equivalent with expressing the User’s consent for the Service Provider’s access to the information collected in the profile to verify allegations expressed in complaints, as well as connected with other reports of possible violations of the Regulations or of the law.
• The content of the User’s profile, including the total amount of the special currency accumulated in the game (Gleemmers), is the property of the Service Provider, from which the User has the right to use, provided the compliance with these Regulations. The content of the User’s account cannot be used in any way outside the game, cannot be exchanged for means of payment of any kind and may not be traded among Users, or other people, with the exception of interactions envisaged and approved by the Service Provider.

Service Provider’s liability

• The Service Provider informs, and Users accept that the Service Provider does not control, nor is responsible for the accuracy or appropriate choice of materials available in the game Tanadu or in other Services, introduced by Users or any third parties.
• The fact that web sites belonging to third parties are connected to the game Tanadu or other Services provided by the Service Provider by an internet reference (link) does not imply that the Service Provider allows or is responsible for these sites’ activities or their content.
• The Service Provider informs that in the use of the game Tanadu and Services provided, caution should be no less than in the case of activities undertaken outside the computer network. It must be taken into consideration that although Users are bound by specific prohibitions, persons acting in the Services can supply information or undertake other actions of unreliable, misleading or even illegal nature. Furthermore, it should be borne in mind that these people are not necessarily those who they say they are. The Service Provider shall not be liable whatsoever for any possible damages resulting from actions of such people.
• Using the services provided by the Service Provider takes place at the sole risk of the users. Therefore, to the extent permitted by the law, the Service Provider and its managers, its suppliers and employees are exempted from any liability arising from, or connected to the Services provided, as well as materials submitted to it by Members or any third parties.
• The Service Provider shall not be liable in relation to persons using the game Tanadu or other Services for any, direct or indirect, loss or damage, loss of data, profits, revenues, and undertakings, in whatever way it would be caused, except for damage resulting from wilful misconduct or gross negligence on the part of the Service Provider or its employees. The Service Provider is also not liable for any infringement in performing its duties under these Regulations resulting from circumstances, for which under the law it assumes no liability.
• These Regulations does not limit in any way the Service Provider’s responsibility for death or personal injury resulting from negligence, or liability of any other kind, which under the law cannot be excluded. Neither does it affect Users’ rights under consumer laws.
• The User is responsible for any possible damage to the Service Provider connected with taking legal action, pressing charges and incurring expenses as a result of the breach of the terms of these Regulations by the User or a device used by them to use the game Tanadu or other Services.

Final provisions:

• In matters not covered by the Regulations or other applicable detailed Rules applied by the Service Provider related to a particular service, relevant provisions of the Polish law are applicable, especially the Civil Code, Copyright Act on Copyright and Related Rights, and Act of 18 July 2002 on providing electronic services.
• In the even of a discrepancy between the provisions of the Regulations and provisions of specific Regulations related to a specific Service, priority is given to provisions of specific Regulations related to a specific Service.
• The Service Provider reserves the right to transfer part or all of the rights and obligations under these Regulations to a third party or to enter into a subcontract with them. The User may not without the written consent of the Service Provider assign or waive rights and obligations under these Regulations.

Complaints:

• The User is entitled to making complaints about providing the Services by the Service Provider.
• The complaint should be delivered to the Service Provider at an e-mail address. Complaints will be investigated successively in the order of their reception by the Service Provider. The complaint should specify the e-mail address at which the response to the complaint is to be sent. Users must also give the accurate description and reason for the Complaint. The Complaint devoid of the data specified in this provision will not be investigated.
• The Service Provider will endeavour to investigate the Complaint within 14 days from its receipt. If the Complaint cannot be investigated within that period, the Service Provider is obliged to notify the User immediately, giving the reason for the delay and the expected date of dealing with the Complaint.
• The person lodging a complaint will be informed of the way of investigating the complaint by e-mail at the address supplied while lodging the Complaint.
• To judge the rights and obligations of the Service Provider as well as the persons using the game in the Polish Republic territory, the Polish law is applied.
• The court competent to adjudicate in the disputes arising in connection with the use of the Service is the competent court for the seat of the Service Provider. Moreover, Can't Stop Games Sp. z o.o. has the right to submit claims at the court competent at the User’s place of residence.

• Users can contact Service Provider using the form at http://www.tanadu.com/pomoc.html.
• Unless stipulated otherwise in the Regulations, Can't Stop Games Sp. z o.o. will communicate with the User by e-mail. The User undertakes to check the e-mail address given regularly as concerns messages received from Can't Stop Games Sp. z o.o. If the User contacts Can't Stop Games Sp. z o.o., they must state which server and which profile the User is referring to and also which Web Sites they are using.

Copyright:

• The Service Provider informs that he has the right to the non-material goods in a form of the graphical project of the game, structure of the game, software that constitutes the basis for the proper usage of the game, as well as any other company designations and signs of goods that belong to the Service Provider and which are used in games; all these goods are protected by proper rules of the law dated at 4th February 1994 and concerning the copyright and related rights, the law dated at 16th April 1933 concerning the fight against an unfair competition, the law dated at 30th June 2000 about the right of the industrial property, the laws of the European Union and bounding international agreements between Poland and other countries.
• By publishing any materials in the scope of the game Tanadu or any other services supplied by the Service Provider, the Users:
  • announce that they have full rights to do that;
  • give the Service Provider a non-exclusive, free of charge, time unlimited license to copy, implement changes, propagate with public presentation and creation and the usage of the contingent parts from these materials only in order to transform and show them in the service frames rendered by the Service Provider; moreover, in the scope of the Tanadu game, in accordance with the following regulations;
  • they agree to adopt the materials in the process of using them, and in consequence – agree not to produce their personal rights; most of all, they agree not to identify themselves as the authors of the mentioned materials.

The possible changes of these regulations:

• In the scope of matters not included in these regulations the employment of the rules of law occurs without exception.
• Can’t Stop Games Sp. z o.o. reserves the right to implement periodical changes into the regulations. In this case the information concerning the employed changes will be present at the main website of the Tanadu game and the new version of the regulations will be put into practice in accordance with the service offer:
  • after a lapse of a month, counting from the day of a public presentation of the changes in the regulations or a later date indicated by the Service Provider if the changes concern material decisions of this regulation and which can have a negative influence on the Users’ situation; if, according to the change, the User doesn’t want to be bounded with the new version of the regulation, he/she should inform the Service Provider before the version will be in a public use and with this date he/she should stop using the Service;
  • immediately after the moment of the public implementation or in any other time indicated by the Service Provider if the changes do not concern material matters, or they won’t affect negatively the situation of the Users exploiting the Services from the Service Provider.
• The invalidity of one of the regulation rules does not affect the others. In case of any doubts and queries the Service Provider obligates himself to substitute the invalid rule by an another rule highly consistent with the aim of the invalid rule. The User will be informed about the change in a standard way.
• The regulations come into force on 31st January 2010.
